Advocacy groups warn Canada’s new border law endangers LGBTQ+ asylum seekers

The advocacy group Rainbow Railroad reports that Canada's new border law, Bill C-12, puts LGBTQ+ refugees at risk of being returned to dangerous countries. The legislation requires asylum seekers to submit their refugee claims within one year of their first arrival in Canada. This technical rule applies retroactively, making thousands of existing claims ineligible for review by the Immigration and Refugee Board. Legal experts note that many LGBTQ+ individuals do not disclose their sexual orientation immediately upon arrival due to safety fears or personal timing. Disqualified applicants must now rely on a pre-removal risk assessment, which has historically low approval rates.
